These Terms & Conditions (“Terms”) govern your access to and use of FestRunner, a festival-management service provided by Good Minded, Inc. (“Good Minded,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. The Service is offered to customers in the United States.

The Service

FestRunner helps festival organizers manage the people, places, schedule, budget, tasks, and communications of their events. Features and plans may change over time. Some plans are offered free of charge to eligible organizations at our discretion.

Your account

You are responsible for the accuracy of the information you provide, for the activity under your account, and for keeping your credentials secure. You must be authorized to act for the festival or organization you set up.

Acceptable use

SMS / text messaging terms

If you enable text messaging, FestRunner sends operational messages only to festival participants who have opted in (for example, by checking an SMS-consent box on your intake form, or by replying to a confirmation text). Message frequency varies with event activity, and message and data rates may apply.

Recipients can reply STOP to opt out at any time and HELP for assistance. As the organizer, you are responsible for having a lawful basis and valid opt-in consent for every number you message. Mobile numbers and SMS consent are never sold or shared for third-party marketing (see our Privacy Policy).

Payments

Paid plans are billed as described at sign-up. Fees are stated in U.S. dollars. Any refund terms are described at the point of purchase.

Your content

You retain rights to the information and content you put into the Service. You grant us the limited rights needed to host and operate the Service on your behalf. You are responsible for your content and for complying with applicable laws.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. FestRunner is an operational tool and is not a substitute for professional, legal, safety, or emergency services; you remain responsible for your event’s decisions and compliance.

Limitation of liability

To the fullest extent permitted by law, Good Minded will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Service.

Termination

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or as needed to protect the Service.

Governing law

These Terms are governed by the laws of the United States and the state in which Good Minded, Inc. is organized, without regard to conflict-of-laws rules.

Changes

We may update these Terms; we will revise the effective date above when we do. Continued use after an update means you accept the revised Terms.
